The Buyer Agreement: 

Exclusive Right to Represent Buyer (Do not submit this with your contract offer).

 Overview: Elements of a contract offer:

  • Residential Sales Contract
  • Conventional Financing addendum or FHA or VA
  • Lender approval letter
  • Copy of Earnest Money Deposit
  • Escalation addendum if applicable
  • Property disclosure addendum

The Buyer agreement

  • Buyer agreement is not submitted to listing agent with contract offer. It is for office internal use only. 
  • States we represent the buyer, but the seller is paying commission. 
  • States at settlement buyer will pay closing costs + $495 admin fee.
  • Signed by buyer and Broker Paul Hartke. (give copy to client)
  • The Sales Contract 
  • If Sellers Market: Full Price. No seller subsidy. Fewest contingencies. 
    If Buyers Market: Full price, maximum seller subsidy. The lender knows that amount which saves the buyer from paying that at settlement..
  • Nice size EMD payable to National Realty ( 1% or more)
  • Financing & appraisal contingencies for  21 days. 
  • Lender letter of approval for  21 days.

  • Property Disclosure addendum: Provided by seller stating being sold “as is”. This can be found already signed by seller in the documents icon at the top left of MLS subject listing.
  • Home Warranty optional: Americas Preferred
    Single Family $425. TH  / condo $399. 
  • Escalation Addendum – Add this addendum if its a sellers market and if property has been on the market a short time. Come in at full price and outbid others. The contract asks for  increments higher and lid price.

    After Ratification: (see after ratification checklist)
  • Copy of EMD – Upon ratification submit to National Realty by giving to management or sliding it into the lockbox on the front desk. Property address and agent last name in memo section.
  • Buyer has 5 days to make written loan application.
  • Make copies of ratified contract for Listing agent, your Buyer, Lender, Settlement company and to your Broker via Case Processing sheets found on www.nat22.com
