You are the listing agent for a rental and a tenant with no representation wants to rent it. You still represent the landlord, but will facilitate the transaction for the tenant. This is not Dual and National Realty will still receive both sides of the commission.
When writing the lease for your landlord client:
1. Lease listing: Check designated agency is allowed, dual is not.
2. Disclosure of Brokerage Relationship for Unrepresented Parties: Tenant signs that we represent the landlord, as they are paying the commission.
3. Lease: National Realty is the Listing Company AND National Realty is the Leasing Company (representing the landlord.)
4. Changing status to “rented”:, National Realty agent is the “leasing agent” and the leasing type is “non-agency” (since we wrote the lease for the tenant but tenant is not our client).
