You are listing a house: What is “as is”? There are two “as is”:
1) All Real Estate sales in Virginia are sold as is pursuant to the property disclosure addendum. (which the seller signs and is provided in other documents in the listing MLS. This “as is” may be subject to home inspections, HOA violations etc.
2) Contingency and Clauses “As is” can be found here. Never check it. It means AS IS no matter what. It is for that extreme case where the seller, no matter what…. even HOA violations, local order violations, smoke detector laws, termites, roof currently leaking, asbestos or just not even a legal house…the seller is not fixing anything nor responsible for any problem. This is never the case.
Conclusion: If you want the house Sold, do not check “as is.”. That is referring to the extreme contingency “as is” and will chase away buyers.
