Writing a contract overview

Writing the contract for your buyer:
 
Under  Earnest money section, do not fill in the date unless its a post dated check. Just put in the amount and National Realty.
 
On HOA and condo docs: Write your email and your clients email.( no postal addresses)
 
Property condition: check it should be “as it is on date of home inspection”. No home inspection? “date of offer.”
 
Property Disclosure: While this is part of all contracts, it should be provided by listing agent/ seller which will state the transaction is “as is”. Usually provided by listing agent, but you can pull up the form and have your buyer sign, if not provided. Seller usually will have it in the listing packet at the house or under documents within the MLS listing.
 
National Realty policy:  No Dual, but we agree to designated.
 
Upon a ratified contract you are to get the deposit into National for deposit immediately. Submit the ratified contract under case processing sheets.
 
Listing and Buyer agreements: Must be signed by the Broker and a copy returned to client.

Case processing sheet: On any ratified contract buyer or seller, fill in a case processing sheet online found at www.nat22.com
 
Short Sales: On the Short Sale addendum, you should mark ” Contract is not considered ratified until approved by third party”. That means the earnest money check will not be deposited until the bank approves.
