Waiving the HOA / Condo documents

 Buyers cannot waive the HOA/Condo packet 3 day cancellation requirement.  The parties can extend the cancellation right 4 additional days, but there is no exception to the buyer’s right to cancel within 3 days. If the buyer receives the documents incomplete or never receives them, the buyer can void the contract and get his EMD back.
 
If on the Listing side, have the seller order those documents immediately after listing agreement is signed. After ratification, provide them to the buyer agent immediately to get those 3 days ticking. Confirm with buyer agents they were received. The Seller is required to provide the packet in the format (electronic or hard copy) as received from the association or condo.  
 
If on the buyer side, in the Sales Contract be sure to provide the email and the physical address in case they do not have them in electronic format.
